Tool-Equip Ltd - Terms and Conditions

This document explains the term and conditions which Tool-Equip Ltd supply items listed on our web site www.toolequip.ie, and from our office, to our customers .We reserve the right to make changes to this website and the details displayed on it, which includes prices.

You should understand that by ordering items from our website, and/or from our office, you accept our full terms and conditions.

1. Price and Payment

The item price payable you see displayed on the website are applicable at the time you place your order with us, except in case of obvious error. Our prices are displayed including vat at 23%. For vat exemption, please contact us with your appropriate exemption documentation for verification, or vat number if based in Northern Ireland (we do not deliver outside the Republic & Northern Ireland).

2. Payment Options

On our website, you now have the choice to pay via Paypal online. We also accept electronic bank transfers by phone, and credit cards, cash & cheques at our trade counter. In the case of the cheques, these may take 5-7days to clear bank, and we cannot release goods until payment is cleared. If your order declines online, please contact us and we will try to make an alternative arrangment.

If ordering online, we must receive payment for your order including delivery, before we can process your purchase. To confirm acceptance of your order we will send you an email to the address provided on your order details. This will create a legally binding contract between us. We reserve the right not to supply at our discretion.

Credit accounts are available to customers doing regular and/or large amounts of ordering, and terms and conditions can be supplied by contacting us.

3. Delivery

Delivery charges will be clearly displayed on your invoice, if value is below the carriage paid order value. We deliver nationwide free of charge for orders over €250.00 + vat, and charge €7.00 + vat for orders below this value for parcels below 30kg. Parcels oversized/pallets over 30kg may carry a surcharge, and this can be priced before order is processed, depending on size etc.

Unless you state that you wish to collect your goods, when placing the order, we deliver them by courier in accordance to your order, normally within 2-3 working days of receipt of order, but this may vary E&O.E. If an item is out of stock, we will contact you with an estimated delivery time/alternative, to see if this is ok. If you need goods by a specific date, we would suggest you contact us by email or phone to ensure we can get them to you on time.

On all deliveries a valid signature will be required, and there must be someone on the premises during normal working hours to accept the delivery. If you wish the goods to be delivered to a building site, please contact us by phone and we will try to arrange this on a case by case basis. In the unlikely event that you have not received your goods within 10 days from the date you placed your order, please notify us immediately.

4. Risk

The items received will be at your risk from time of delivery.

5. Title

Ownership of items purchased will only pass to the customer upon receipt of full payment of all sums due, including any appropriate delivery charges.

6. Liability

Tool-Equip Ltd is not responsible for any injury sustained through the use of any tools purchased through this website, whether the injury is incurred through use or misuse, delivery, storage, handling or mishandling. www.toolequip.ie is not responsible for any loss of business or livelihood due to any malfunction or mis-operation of any tool purchased through this site. It is the User's responsibility to observe safe and prudent tool-handling practices and to read manufacturers manuals, included with each tool.

7. Access to Website

Users of this website agree to in no way attempt to "hack" or otherwise gain unlawful access to our server, its files or directories, nor to copy the images, HTML code, layout or design of this website, for personal or commercial use.

8. Stock Availability

At Tool-Equip Ltd we try our best to ensure that the products featured on our website are in stock, however some items may be temporarily out of stock due to production availability or unexpected demand, or simply an administration error. We will inform you if there are any delays of a product, and offer you choice of a nearest possible alternative, a full refund, or if you are happy to wait for the delivery we can backorder it for you.

Products that are in stock will be normally be delivered to you within 2-3 working days E&O.E.

9. Cancellation of Order/Refunds

Orders for items featured online can be cancelled with a full refund, providing goods have not been despatched already. If product has already left us for delivery, this item must be brought to our attention by emailing us at sales@toolequip.ie within 7 days of product being delivered. All goods must be returned to our specified address within 10 working days of delivered to you, at your cost, in its original packaging, in full working order, and be in resalable condition. Unwanted goods/Cancelled order already delivered will incur a stock return charge of 25% of the total product value to a minimum value of €10, unless there’s evidence of goods being out of their packaging, handled or used by the customer, in which case, we will return the goods to you, without any refund.

10. Returns under Warranty

All our products carry a one year warranty, although some manufacturers may have an extended warranty available, if you register with them directly online.

Where faulty or damaged goods are returned to us under warranty, we reserve the right to carry out authorised repairs (in accordance with the manufacturer’s warranty) and return the product to you at our expense, within a reasonable time (usually 10-21 days). If it’s deemed that the item is not covered by the manufacturer’s warranty, the customer will be liable for the repair costs, which must be paid for, before goods can be returned. Replacement or Refunds will be given in cases where the manufacturer’s repair of the product does not fix the problem, or where the tool is un-repairable, or unviable to repair. Refunds will be made on the same credit card or debit card that you made initial payment on only.

To make a return please contact us in writing and we will arrange for our courier to come and collect it from you, once the item is packed and labelled by the customer.

This does not affect your statutory rights as a consumer.

11. Personal Details/Security

The information that you provide us enables us to process your orders and deliver them to you, and is necessary to complete the transaction. We would recommend including a mobile phone number in case there is no-one on the premises at the time of delivery.

Your personal information is confidential. Tool-Equip Ltd do not allow third party access to any customer information.

12. Collection of Orders
